The Notice on Strictly Implementing the rovisional Regulations Governing the Foreign-invested Movie Theater

  The commissions (departments and bureaus) of foreign trade and economic cooperation of all provinces, autonomous regions, municipalities directly under the central government as well as municipalities specially listed in the State economic plan:
  The Provisional Regulations Governing Foreign-invested Movie Theater (hereinafter referred to as the Provisional Regulations), formulated by the State Administration of Radio, Film and TV, Ministry of Foreign Trade and Economic Cooperation and Ministry of Culture, has been promulgated and implemented since October 25, 2000.
  The promulgation of the Provision Regulations is one of the important measures to steadily promote the reform and opening up of the service trade. All the localities and departments must implement the Provision Regulation strictly. Therefore, it is reiterated as follows:
  1. The foreign investors who invest in and establish the movie theater must be strictly governed by Article 6 of the Provisional Regulations. With consent of the provincial film administrative departments, the provincial department of foreign trade and economic cooperation where the project islocatad should submit the report on the project to MOFFEC. After getting the consent from the State Administration of Radio, Film and TV and the Ministry of Culture, MOFTEC will carry out appraisal work on the basis of Chinese laws and regulations on foreign investment. MOFTEC will issue the Approval Certificate for Foreign-Invested Enterprise for the approved foreign invested enterprises.
  2. According to Article 4 of the Provisional Regulations, the movie theater established with foreign investment only exists as a sino-foreign equity joint venture or a Sino-foreign cooperative enterprise.
  3. The Slate administrations of industry and commerce will process the enterprise registration when the pproval Certificate for Foreign-Invested Enterprise issued by MOFTEC and other relevant documents are available.
  4. After the promulgation of the Provisional Regulations on October 25, 2000, if a foreign-invested enterprise of movie theater is established with the approval granted by a department which does not abide by the Regulations by exceeding its due authority in approving the enterprise, the Approval Certificate for Foreign-Invested Enterprise thus granted shall not be valid. In addition, MOFTEC will require the department making unauthorized approval to retrieve the Approval Certificate for Foreign-Invested Enterprise within a stipulated time period; MOFITEC may also publicly denounce this department, order it to make rectification within a definite time, and even evoke the MOFTEC's authorization to the department for issuing Approval Certificate for Foreign-Invested Enterprise. Accordingly, the film adminisutrative department will not issue the Operation Permit for Movie Theater while the administration of industry and commerce will confiscate the business license of the enterprise.
